What is Family Mediation?
Family mediation involves you and your former partner sitting down with an independent third person (a mediator) to discuss the legal issues of your settlement. It’s not counseling, but an opportunity to set out proposals, consider options, and attempt to reach a mutual agreement.
Our mediation process helps you understand each other’s perspectives and find common ground, especially beneficial in cases involving children.

What are the Benefits of Family Mediation?
Taking a family dispute to court is often a drawn-out and expensive process. Compared to going through the legal system, family mediation can save you time and money. Court fees tend to escalate quickly, whereas mediation is much more affordable. Scheduling just one court hearing can take months, so if you’re looking for a quick resolution, family mediation may be a more appealing option.
Family mediation also gives separated couples the chance to find common ground, allowing them to resolve disputes before they get too heated. This can be especially beneficial in cases involving children.
Frequently Asked Questions
Are there any disputes that are not suited to family mediation?
Family mediation may not be suitable where there are domestic violence allegations or orders, or where there may be a power imbalance between the parties. The mediator will determine if your matter is suitable for mediation or speak to a lawyer prior to engaging in the mediation process
Does the mediator have the power to decide the most appropriate resolution?
It is not the mediator's role to make final decisions. It is their job to oversee the process and facilitate negotiations.
Do I have to attend family mediation?
If you are unsure about attending mediation, we recommend that you obtain specialist family law advice prior to refusing to engage in mediation. There are certain pre-action procedures that should be followed in all family matters, and you should understand them prior to agreeing or refusing to participate in mediation.
Will I get an opportunity to speak privately with the mediator?
Separating couples may not always feel comfortable raising certain issues in front of their former partner. For this reason, the mediator will often have private confidential sessions with each party. It should be noted that the most common form of mediation is a ‘shuttle’ conference, where parties are in separate rooms and don’t see each other.
How do I prepare for mediation?
Make sure you understand what the process involves, this might include obtaining legal advice prior to the mediation. The mediator will explain the process to you either before the mediation or on the day of mediation. We recommend that you have a have a good idea of the legal issues and your position in relation to the issues prior to the mediation. It would also be of assistance for you to obtain legal advice on the issues and your position prior to the mediation.
Is mediation confidential?
Information or documents disclosed in mediation are confidential. Only in limited circumstances can information be provided to third parties. If these limited circumstances apply, the mediator will discuss this with you on a case-by-case basis.
Can I have a support person at mediation?
Yes, if you wish to have a support person at mediation then raise this with the mediator prior to the mediation occurring.
